(Navigating the mire of Council requirements to simplify the application process for the man in the street)

Introducing you to Christopher (Chris) Ansoul, a building and planning professional with over 40 years’ experience in Local Government building certification and development approvals; who can help you work through the simplest and the most complex issues and help in the preparation of all the necessary documentation in the application process.


How may I help:

1. Preparation and assist with the completion of application forms;
2. Advise and research with regards compliance with Council (DCP) rules and state legislation (LEP);
3. Provide insight into the interpretation and implementation of Council’s (performance & prescriptive) requirements to achieve your preferred outcomes;
4. Obtain all required background details and data from state and Council records required for your submission;
5. Accompany clients and make written and verbal representations on your behalf at pre-submission meetings;
6. Preparation of your SOE (Statement of Environmental Effects) required with every D/A;

a. This outlines the state and local planning requirements applicable to your development proposal;
b. Stipulate/s the way in which your development meets all the requirements outlined, while satisfying Council and your desired outcome/s;
c. Engage suitable professionals to provide any specialist reports & the like that may be required for your application.

7. Through associates, recommend the use of various professional services in the preparation of architectural, engineering plans& specialists reports which may be needed for the development application to proceed;
8. Represent your interests with written and verbal contact with such professionals to ensure your interests are foremost in the preparation and subsequent documentation preparation;
9. BCA insights, interpretation & identify loopholes;
10. Identify likely Fire Safety Upgrades required by Council (Reg 93 & 94 of EP & A Act);
11. Disabled access requirements for additions & alterations to commercial premises.

Interpretation of Terms used above

LEP = Local Environmental Plan. This is the planning document that zones the land the subject of the application and outlines the activities that may be permitted and those that are prohibited.

DCP = Development Control Plan. This is the Council devised standards that the Council would apply to the subject development. This has prescriptive requirements that if met by the development, may go ahead in accordance with the standard. There are, however, performance requirements that, if the submission meets the desired outcomes of the DCP (subject to a submission that is accepted by Council), it may also proceed in accordance with the submission.

C/C’s = Construction Certificates. Building approval issued by Accredited Certifiers, who may be Councils or private individuals. Previously known as Building Applications. Contains architectural and engineering plans to be followed in the building process. Issued following approval of the development through the D/A process.

CDC’s = Complying Development Certificate. The same as the above but applies only to developments that are part of the schedule under the Exempt and Complying Development DCP that do not require a D/A approval and may be issued by Accredited Certifiers only.

BCA =Building Code of Australia.

EP&A = Environmental Planning & Assessment Act (NSW Planning & building Act legislation).
